Abstract

This paper critically examines consumer protection in the digital era, focusing specifically on legal safeguards against online shopping fraud in India. The study begins with an introduction outlining the growing significance of e-commerce and the associated risks of fraudulent activities in online transactions. It then explores the various types and notable instances of online shopping fraud, highlighting how sophisticated schemes such as credit card theft, refund fraud, and fake seller scams have increasingly imperilled consumers and businesses alike. The impact of these fraudulent activities on society is discussed in terms of financial loss, erosion of trust, psychological distress, and operational burdens on both consumers and e-commerce platforms. The legislative framework addressing online shopping fraud in India is comprehensively analysed, emphasising the Consumer Protection Act, 2019, the Consumer Protection (E-commerce) Rules, 2020 and complementary provisions under the Information Technology Act and BNS criminal statutes. These laws collectively create obligations for e-commerce entities, extend protections to consumers and establish enforcement mechanisms through the Central Consumer Protection Authority. Significant judicial responses are reviewed, showcasing recent landmark judgments that affirm platform liability, consumer rights, and the judiciary’s willingness to address complex digital fraud cases. A comparative analysis with other countries such as the United States, the United Kingdom, and Australia illustrates how India can learn from global best practices, including the use of AI-powered fraud detection, stringent seller verification and coordinated regulatory enforcement. The conclusion synthesises these insights by emphasising the necessity for a multifaceted approach that combines rigorous legal safeguards, judicial vigilance, and cutting edge technological tools to safeguard consumers effectively. The paper closes with practical suggestions aimed at enhancing enforcement capacity, increasing consumer awareness, mandating transparency, technological innovation, streamlining dispute resolution and fostering international collaboration to mitigate online shopping fraud.
